Terms of Service

These Terms govern your use of the A11yProof service operated by Talivio Technology OÜ (registry code 16991406, Ahtri tn 12, Kesklinna linnaosa, Tallinn, Harju maakond, 15551, Estonia — "Talivio", "we"). By using the service you agree to them. The service is intended for business and professional use. If you nonetheless use it as a consumer, the "Consumers" provision in section 11 applies.
1. The service
A11yProof runs automated accessibility checks (based on the axe-core engine) against web pages you submit, monitors pages over time, and generates reports and compliance evidence files. It is a testing tool, not a certification body, and its output is not legal advice.
2. No compliance guarantee
A11yProof is a testing tool, not a certification body. Its results are provided "as is". Automated testing detects only a subset of accessibility issues — typically around 30–40% of WCAG success criteria — and cannot evaluate criteria that require human or assistive-technology judgement. A passing scan does not certify that a page is fully conformant or legally compliant; full conformance requires manual review and testing with assistive technologies. A11yProof results — including scan reports, grades, badges, AI pre-checks and expert reviews — do not constitute legal advice or a guarantee of conformance with WCAG, EN 301 549, the European Accessibility Act, the ADA, or any other standard or law. AI-generated pre-checks are unverified suggestions; expert reviews reflect a reviewer's professional judgement at the time of review and are not a certification. You remain responsible for your own accessibility obligations.
3. Authorization to scan and indemnity
You may only submit URLs that you own or that you are authorized to test — for example a client site you have been engaged to audit. A11yProof performs active testing: it loads the target page in a headless browser and injects the axe-core script into it to evaluate the rendered document. This goes beyond passively reading a page, so you must ensure your authorization covers such automated interaction.
You represent and warrant that, for every URL you submit, you hold all rights and authorizations necessary for A11yProof to load and test it, and that the scan does not violate applicable law, the target site's terms, or any third party's rights. You agree to defend, indemnify and hold harmless Talivio Technology OÜ and its personnel from and against any claims, proceedings, regulatory fines or investigations, damages, losses and costs (including reasonable legal fees) arising out of or relating to URLs you submit without the necessary authority or in breach of this section. This obligation survives termination of these Terms.
4. Your account
You must provide accurate information, keep your credentials secure, and you are responsible for activity under your account.
5. Acceptable use
- Do not use the service to disrupt, overload, or gain unauthorized access to any website or to the service itself.
- Do not attempt to reverse-engineer the service or use it to build a competing scanning product.
- Do not misrepresent A11yProof results — for example by presenting a scan report or badge as a certification of legal compliance.
6. Fees, subscriptions and one-off purchases
Paid subscriptions are billed in advance through Stripe on a monthly or yearly basis and may be cancelled at any time; access continues until the end of the paid period. One-off products (such as audits, re-checks and expert reviews) are paid once and fulfilled once. Prices are in EUR and exclude VAT where applicable. Fees already paid are non-refundable unless required by law. We may change prices with effect from your next billing period.
7. Intellectual property and your data
We own the A11yProof platform and its content. You retain ownership of the data you submit; you grant us the rights needed to host and process it to provide the service. Where scanned page content includes personal data of others, we process it as your processor as described in the Privacy Policy. On request, we will enter into a GDPR Article 28 data processing agreement with business customers; our standard DPA is available at [email protected].
8. Availability
The service is provided "as is" and "as available", without warranty of uninterrupted or error-free operation. We may change, suspend, or discontinue features at any time. The service also depends on third-party systems we do not control — including Stripe and AI providers — and we are not responsible for their availability or for changes they make. This disclaimer does not affect the statutory conformity rights that consumers have under Directive (EU) 2019/770 and applicable national law, which remain unaffected.
9. Limitation of liability
To the fullest extent permitted by law, Talivio Technology OÜ is not liable for indirect, incidental or consequential losses, loss of profits, or for regulatory penalties, legal claims or other consequences of decisions made in reliance on scan results, reports or reviews. Our total aggregate liability under these Terms is limited to the fees you paid us in the twelve months before the event giving rise to the claim; where you use the service free of charge, our aggregate liability is limited to EUR 100.
This limitation does not apply to liability that cannot be limited under mandatory law, including liability for intent (wilful misconduct) or gross negligence, for death or personal injury, or under mandatory consumer-protection law.
10. Termination
You may stop using the service and close your account at any time. We may suspend or terminate access for breach of these Terms.
11. Governing law
These Terms are governed by the laws of Estonia, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Harju Maakohus (Harju County Court) in Tallinn. Nothing in this clause deprives you of the protection of mandatory provisions of the law of your country of habitual residence or establishment that cannot be derogated from by agreement.
Consumers. The service is intended for business and professional use. If you nonetheless use it as a consumer, mandatory consumer-protection provisions of your country of habitual residence apply, and the Governing Law, Limitation of Liability and warranty-disclaimer provisions apply only to the extent that mandatory law permits.
12. Changes to these Terms
We may update these Terms; continued use after an update means you accept the revised Terms. The date at the top shows when they last changed.
